Miami Rideshare Accident Lawyer
Uber & Lyft Accidents in Florida
In recent years, rideshare services such as Uber and Lyft have become a popular means of transportation compared to taxi services and public transportation. Whether you need a ride home after a fun night out or need to be dropped off at the airport, you can simply use an app to request a ride and a driver will pick you up within minutes to take you to your destination. Unfortunately, Uber and Lyft accidents still occur.
If you have been injured in a car accident with an Uber or Lyft driver in Miami, let our legal team at Stabinski Law help you recover your entitled compensation for your medical expenses, lost income, and pain and suffering. We can investigate the crash, collect and review evidence, negotiate with insurance companies, and maximize the compensation you deserve.

How Insurance Works for Rideshare Companies
Uber and Lyft do not hire their own drivers or own, operate, or otherwise control the vehicles they drive. Additionally, these drivers are considered “independent contractors,” rather than employees, which means they are not entitled to a wide range of benefits or protections. Therefore, Uber or Lyft may not be directly held liable for the accident or any injuries.
However, both rideshare companies provide liability coverage for their drivers during certain situations. Otherwise, a driver’s personal insurance policy will apply.
Here is a breakdown of how insurance works for Uber and Lyft:
- The app is turned off – When the driver is not logged into the Uber or Lyft app, then his/her personal auto policy applies.
- The app is on, and the driver is waiting for a ride request – When the driver is logged into the app but has not accepted a ride request yet, Uber and Lyft provide up to $50,000 per person injured in a crash, up to $100,000 per accident, and up to $25,000 for property damage in liability coverage for any collision caused by the driver.
- The driver accepts a ride – When the driver has accepted a ride request and is in the process of picking up the passenger, Uber and Lyft provide up to $1,000,000 in liability coverage.
- The rider is in the vehicle – Uber and Lyft provide up to $1,000,000 in third-party liability coverage, uninsured motorist (UM)/underinsured motorist (UIM) coverage, and contingent comprehensive and collision coverage up to the actual cash value of the vehicle.
So, if a rider is injured in an accident caused by an Uber or Lyft driver, the rider has the right to hold either rideshare company financially responsible for their injuries and other losses. However, it is not uncommon for Uber and Lyft to try to avoid paying claims by showing that the driver’s auto coverage does not cover commercial activities or show that the driver was between fares when the crash happened. It is imperative to hire an experienced personal injury attorney for rideshare accident claims due to their complexities.
